Acceptance of Terms
By signing up for or using any Dark Horse Virtue service (“Services”), you accept these Terms of Service (“TOS”) in full. We may update the TOS at any time. If a change is material, we will post a notice here and, where practical, email the address on file 30 days before it takes effect. Continuing to use the Services after that date means you accept the revised terms.
Description of Services
Dark Horse Virtue provides cloud hosting, domain registration, SSL, software tools, and related support designed to put creators and small business owners in direct control of their digital presence. All Services are delivered “AS IS” and “AS AVAILABLE.” We offer no blanket warranties regarding uptime, speed, or fitness for a particular purpose, but we do pledge:
a veteran-disciplined approach to platform security,
transparent communication about incidents and maintenance, and
the freedom for every client to build, migrate, or export their data at any time.
User Responsibilities
You are the steward of your account and agree to:
Comply with the law and with our Acceptable Use Policy.
Keep credentials and API keys secret and use strong, unique passwords.
Maintain current backups of critical data.
Patch and update the software you install—CMSs, plugins, themes, and any custom code—on a timely basis.
You may not use the Services to harass, defame, infringe, exploit, or distribute malware.
Service-Specific Terms
Domain Registration
Domains are registered via Enom. Their registrar agreements apply.
Registrant changes trigger an automatic 60-day transfer lock.
You are responsible for renewing your domains, even if auto-renew is enabled.
You must ensure the domain does not infringe on any third-party rights.
SSL Certificates
You must supply accurate certificate-signing information and install the certificate (For Pro Suite accounts, this is handled automatically via AutoSSL).
Approval, issuance speed, and warranty (if any) are controlled by the Certificate Authority.
Shared Hosting (Pro Suite)
Resource caps on disk, CPU, RAM, and bandwidth preserve fair use for all clients.
Excessive or abusive use may be throttled or suspended until mitigated.
Dark Horse Virtue Software
Licensed for use only on Dark Horse Virtue infrastructure unless released under an open-source license.
Redistribution, reverse-engineering, or removal of attribution is prohibited. See the full Software section below.
(Dedicated servers, VPS, and managed WordPress plans inherit these TOS but may include extra SLAs spelled out at purchase.)
Software
Third-party applications (including “one-click installs”).
These are published under their own licenses. The third-party publisher controls updates and support. Dark Horse Virtue provides only the installation conduit and accepts no liability for code we did not write.Dark Horse Virtue utilities and plug-ins.
You receive a revocable, non-exclusive, non-transferable license to run proprietary tools solely on our servers. Open-source components remain under their respective licenses.
We support the platform we build. Third-party application support rests with their publishers or communities.
Suspended & Terminated Accounts
Accounts may be suspended for non-payment, AUP violations, or security emergencies.
If an account remains unpaid for 30 days, we may delete it and all data.
Upon written request and payment of any past-due balance plus a restoration fee, we will attempt to recover data from the most recent backup, but success is not guaranteed.
30-Day Money-Back Guarantee
First-time Pro Suite shared-hosting orders are eligible for a full refund within 30 days of service creation. Domain fees, dedicated servers, custom IPs, software installs, and abuse-related terminations are excluded. Refund requests must be submitted through the client portal.
Privacy & Data Protection
Our Privacy Policy explains how we collect, store, and process data. By using the Services you consent to that policy. Where you handle personal data of your own customers, you are the controller and must comply with applicable privacy laws.
Billing & Payment
Prices are listed in USD and exclude taxes.
Invoices are due on receipt unless a custom schedule is stated.
Accounts 15 days past due may be suspended.
A late fee of 10 % applies after 30 days.
Resource Overage Fees (Shared Hosting — Pro Suite)
Disk space: first 20 GB included; $0.50 per additional GB per month
Email accounts: first 5 included; $0.75 per additional account per month
MySQL databases: first 2 included; $1.25 per additional database per month
Sub‑domains: first 1 included; $4.00 per additional sub‑domain per month
Add‑on domains: $4.00 per domain per month
Parked domains: $4.00 per domain per month
Overage charges are calculated monthly in arrears and added to your next invoice.
Development Services
Dark Horse Virtue offers fixed-price and custom-scoped development solutions ranging from website builds to API integrations. The terms below apply to every development engagement.
Scope & Statement of Work (SOW)
Each project includes a written SOW describing features, deliverables, and timeline.
Work beyond the SOW requires a mutually signed change order and may affect price or schedule.
Access & Configuration Authorisation
By commissioning Dark Horse Virtue, you authorise our engineering team to enter your hosting account(s), CMS, databases, third-party services, and related systems as needed to fulfil the SOW. This permission covers uploading or editing files, creating backups, installing or configuring software, and adjusting server or application settings. We will
use credentials only for project purposes,
limit changes to what is reasonably necessary, and
document material modifications.
Client Responsibilities
Provide timely access to assets, credentials, and decision-makers.
Review interim deliverables within five (5) business days; lack of feedback within that window counts as acceptance for scheduling purposes.
Milestones & Payment Schedule
Fixed-price products are prepaid in full.
Custom projects may be invoiced 50 % up-front and 50 % upon final acceptance, unless otherwise stated in the quote.
Late payments over 30 days accrue a 10 % late fee and may pause active work.
Acceptance & Warranty
A seven-day review window starts when we deliver the final milestone. Report material defects in writing within that period; otherwise, the project is deemed accepted.
Dark Horse Virtue provides a 30-day post-launch warranty to correct verified defects originating in our code at no additional cost.
Intellectual Property
Upon full payment, you receive a perpetual, worldwide licence to use, modify, and distribute the custom code for your own business purposes.
Dark Horse Virtue retains the right to reuse non-client-specific frameworks, libraries, and methodologies developed during the project.
Support & Maintenance
Ongoing support, feature enhancements, or security updates beyond the warranty window require a separate maintenance agreement or hourly retainer (Pro Suite Manage accounts exempt).
Cancellation
If you cancel before completion, you remain liable for work performed to date, calculated at the percentage of milestones delivered or at our prevailing hourly rate for time logged.
Intellectual Property
Dark Horse Virtue retains ownership of all company marks, logos, and proprietary software. You retain ownership of the content and code you upload. You grant us a limited license to host, cache, and serve your material solely to operate the Services.
Termination
By you: Cancel any time through the client portal. Pre-paid fees are non-refundable except under the 30-day guarantee. Export or delete your data before the termination date; residual copies are erased in routine backup rotations.
By Dark Horse Virtue: We may suspend or terminate Services for material breach of these TOS or the AUP, non-payment, or to comply with law. When feasible we will give 48 hours’ notice so you can export data.
Dispute Resolution & Governing Law
These TOS are governed by the laws of the State of Arizona, U.S.A., without regard to conflict-of-law rules. Venue for any dispute shall be the state or federal courts located in Tucson, Arizona. Before filing suit, both parties agree to attempt good-faith informal resolution for at least 30 days.
Changes to These TOS
The “Last Modified” date at the top of this page reflects the latest revision. Material changes will be highlighted in the client portal and via email. Non-material edits (clarity, typo fixes) may occur without direct notice.

AI Policy
AI Policy
Definitions
Artificial Intelligence (AI) – Software that uses machine-learning techniques—such as large-language models, computer vision, or natural-language processing—to generate, classify, or transform data.
MyCelf Intelligence AI Engine – Dark Horse Virtue’s in-house AI engine. It powers chat assistants, code generators, content-automation tools, and other features built on OpenAI models (currently o1,GPT-4o, and GPT-4.1).
User Content – Any text, images, code, or files you submit while interacting with MyCelf Intelligence or other AI features.
How Your Data Moves
Your prompt and attachments travel over TLS from your browser to Dark Horse Virtue’s servers.
We relay the encrypted request to OpenAI’s API.
OpenAI keeps request and response data for up to 30 days solely to monitor abuse, then deletes it. The data is not used to train OpenAI models unless you have explicitly opted in.
The AI response returns to you over TLS. A copy remains in your account history unless you delete it.
Our Use of Your Content
We Do
Forward your prompts to OpenAI to generate responses.
Store conversation history in your account so you can view or export it.
Analyze anonymized usage patterns to refine prompts, safety filters, and cost estimates.
We Do Not
Train our own models on your private files or chats without your written consent.
Opt you into OpenAI’s training programs.
Sell or rent your data to advertisers or data brokers.
Your Choices & Controls
Opt-Out of Prompt Improvement
Email support[at]darkhorsevirtue.io with the subject “AI OPT-OUT.”
Request Deletion
Delete items in your applicable dashboard or email support with conversation IDs. We erase local copies and forward the deletion request to OpenAI; final removal normally completes within 30 days.
Export History
Click Export in your applicable dashboard or email support to receive a JSON download of your AI interactions.
Security Measures
All traffic between you, Dark Horse Virtue, and OpenAI is encrypted (TLS 1.2+).
Access to AI logs is limited to authorised staff following least-privilege rules.
Regular vulnerability scans and secure-coding reviews protect the MyCelf Intelligence AI Engine.
Prohibited AI Uses
MyCelf Intelligence may not be used to:
Generate or distribute illegal content, harassment, or hate speech.
Create deepfakes or impersonations without consent.
Share personal data you are not authorized to disclose.
Violate any clause of the Acceptable Use Policy.
Violations can result in suspension or termination of AI access and, if necessary, wider account action.
Model Versions & Future Changes
AI models evolve quickly. We may adopt newer versions (e.g., GPT-5-series) or additional providers. Any change that affects data-handling practices will be announced at least 30 days in advance and this policy will be updated.

Acceptable Use Policy
Acceptable Use Policy
At Dark Horse Virtue, we champion digital ownership, responsible stewardship, and a level playing field for every creator. To preserve that mission—and to protect the stability and security of our platform—clients agree to the following Acceptable Use Policy (“AUP”). Violating this AUP may result in suspension or termination of Services without refund Dark Horse Virtue.
1. Prohibited Content & Activities
You may not use Dark Horse Virtue infrastructure to host, store, share, or transmit:
Illegal material – content that violates any applicable law or regulation.
Intellectual-property infringements – unlicensed software, pirated media, counterfeit goods, or any content that infringes copyrights, trademarks, patents, or trade secrets.
Malicious or deceptive assets – malware, ransomware, phishing pages, “spoofed” sites, or fake storefronts.
Harassment or hate – material that threatens, bullies, or promotes violence or discrimination against individuals or groups.
Sexual exploitation – non-consensual explicit imagery, child sexual abuse material (CSAM), or any content that sexualizes minors.
Extremist propaganda – content that glorifies or supports terrorist or violent extremist organizations.
Open proxies or anonymisers intended primarily to facilitate illicit activity.
2. Email & Messaging (“No-Spam Rule”)
Bulk email, SMS, or messaging campaigns must comply with CAN-SPAM, CASL, and other anti-spam laws. Specifically:
Obtain verifiable, opt-in consent.
Include accurate sender details and a one-click unsubscribe link.
Maintain bounce/complaint rates below industry norms (generally < 0.3 % of sends).
Sending unsolicited, deceptive, or abusive messages—including “snowshoe” or “pump-and-dump” campaigns—will trigger immediate investigation and possible service suspension.
3. Resource Usage
Our shared environment relies on fair usage. You agree to:
Stay within the CPU, RAM, disk-I/O, and bandwidth allocations of your plan.
Avoid sustained processes that monopolize resources—e.g., cryptocurrency mining, video transcoding farms, or stress-testing tools—without a dedicated server or prior written approval.
Configure caching, rate limits, and security headers to keep your sites performant and secure.
If your workload threatens platform stability, we will notify you with mitigation steps. Failure to mitigate in a reasonable time may result in throttling or suspension.
4. Security Expectations
Keep all software—including WordPress plugins, themes, and server-side packages—patched and up to date.
Use strong, unique passwords and enable multi-factor authentication where offered.
Promptly investigate and remediate any compromise of your account, API keys, or hosted code.
Never scan or attempt to penetrate other networks from our servers without explicit, written permission from those network owners.
5. Data Protection & Privacy
Clients are responsible for safeguarding personal data they collect or process on Dark Horse Virtue. This includes:
Complying with all relevant privacy laws (e.g., GDPR, CCPA).
Posting a clear privacy notice on public-facing websites or apps.
Encrypting sensitive data in transit (TLS) and at rest where feasible.
6. Enforcement & Remedies
Notice & Cure. For most first-time, non-egregious violations we will email a detailed notice and give you a reasonable window to cure.
Immediate Action. Severe offences (e.g., phishing, CSAM, botnet control, or platform-wide disruption) may trigger instant suspension or data deletion without prior notice.
Investigation Cooperation. You agree to cooperate with any investigation into suspected abuse, including providing relevant log files or configuration details.
Right to Refuse Service. We reserve the right to refuse, suspend, or terminate Services at our discretion to protect the integrity of the platform or comply with legal obligations.
7. Updates to This AUP
Technology and threats evolve. Dark Horse Virtue may modify this AUP at any time by posting the updated version on our website. Continued use of the Services after changes take effect constitutes acceptance of the revised policy.

Terms & Conditions | Pro Suite Affiliate
Pro Suite Affiliate
This agreement governs the relationship between Dark Horse Virtue (“Company”) and any Pro Suite account holder who joins the Pro Suite Affiliate Program (“Affiliate”). By participating, the Affiliate agrees to the terms below.
Commissions
Rate – Ten percent (10 %) of hosting fees actually collected on each new account referred by the Affiliate.
Qualifying period – A commission is earned only after the referred account has remained active, paid-up, and not refunded for forty-five (45) consecutive days.
Payment schedule – Commissions are calculated at the end of each month and paid on a net-30 basis. The Company may offset or withhold commissions to account for any refunds or chargebacks related to the referral.
Affiliate Responsibilities
Promote Dark Horse Virtue accurately and avoid misleading statements.
Follow all applicable laws, regulations, and the Company’s Acceptable Use Policy.
Keep any non-public information provided by the Company confidential.
Independent Contractor Status
The Affiliate participates as an independent contractor, not an employee, and is responsible for all taxes or reporting obligations arising from commission payments.
Limitation of Liability
The Company is not liable for any representations made by the Affiliate beyond the scope of these terms. The program is provided “as is,” without warranties of any kind.
Termination
Either party may end the Affiliate’s participation at any time, for any reason, by providing notice. Commissions on qualifying referrals accrued up to the termination date will be paid according to the normal schedule.
Acceptance
Participation in the Pro Suite Affiliate Program constitutes acceptance of these terms.
Terms & Conditions | PS-Dev Associate
Pro Suite Dev Associate
This agreement governs the relationship between Dark Horse Virtue (“Company”) and PS Dev Associates (“Associate”) who participate in the Company’s premium referral program.
Commissions
Rate – Fifty-three percent (53 %) of hosting fees actually collected on each new account referred by the Associate.
Payment schedule – Commissions are calculated at month-end and paid net-30. The Company may adjust commission amounts to reflect any refunds or chargebacks.
Associate Responsibilities
Promote Dark Horse Virtue’s services and, if desired, the Associate’s own web-development offerings in an accurate and ethical manner.
Refrain from misleading claims or unauthorized guarantees.
Comply with all laws, regulations, and Company policies while conducting promotional activities.
Independent Contractor Status
Associates are independent contractors, not employees. They bear responsibility for their own taxes and regulatory compliance.
Limitation of Liability
The Company is not liable for promises or commitments the Associate makes beyond the scope of this agreement.
The Pro Associate program is provided “as is,” without express or implied warranties.
The Associate agrees to indemnify and hold the Company harmless from any claim arising from the Associate’s breach of this agreement or unlawful conduct.
Termination
The Company may terminate this agreement at any time, with or without cause, by notifying the Associate.
Upon termination, the Associate must cease all promotional activities and will not earn future commissions on new referrals. Qualifying commissions accrued before the termination date remain payable.
Entire Agreement & Amendments
This document constitutes the entire agreement between the Company and the Associate regarding the Pro Associate Program and supersedes all prior understandings. The Company may amend these terms at any time; changes take effect upon notice to Associates.
Acceptance
By participating in the Dark Horse Virtue Pro Associate Program, the Associate accepts and agrees to these terms.
Acceptance of Terms
By using Dark Horse Virtue’s services, you are agreeing to these Terms of Service (“TOS”). It is important that you read and understand the TOS as they govern your use of our services. Dark Horse Virtue reserves the right to update and change the TOS from time to time without notice.
Description of Service
Dark Horse Virtue provides a variety of technology services (“Services”). You understand and agree that these Services are provided on an AS IS and AS AVAILABLE basis. Dark Horse Virtue disclaims all responsibility and liability for the availability, timeliness, security or reliability of the Services or any other client data.
Privacy Policy
Dark Horse Virtue deeply respects the privacy of its users. Our Privacy Policy explains our practices relating to the collection and use of your information through or in connection with our Services. By using the Services, you signify your agreement to this Privacy Policy.
Billing and Payment
You agree to pay all applicable fees related to your use of our Services. All fees are exclusive of applicable taxes, levies, or duties, which you will be responsible for. If Dark Horse Virtue cannot charge your payment method for any reason, we reserve the right to either suspend or terminate your access to the platform and account and terminate these TOS.
Development Billing Terms
All development services and solutions are provided as fixed-rate products based on defined deliverables. Each service is billed according to its listed price at the time of purchase. Work is scoped clearly through each product description to ensure transparency regarding what is included.
Development Payment Terms:
Payment for development services is due at the time of order unless otherwise specified. For custom-scoped projects outside of predefined service offerings, a separate quote will be provided. Invoices for custom projects are due by the last day of the subsequent month after services are rendered. A 10% late fee applies to any past-due invoices. Failure to remit payment within 30 days of the due date may result in suspension of services and/or legal action to recover owed amounts.

Intellectual Property Rights
All materials on Dark Horse Virtue’s Services, including, without limitation, names, logos, trademarks, images, text, columns, graphics, videos, photographs, illustrations, artwork, software and other elements are protected by copyrights, trademarks and/or other intellectual property rights owned and controlled by Dark Horse Virtue or by third parties that have licensed or otherwise provided their material to us.
Termination
Dark Horse Virtue reserves the right to suspend or terminate your account and prevent access to the Services for any reason, at our discretion. Dark Horse Virtue reserves the right to refuse to provide the Services to you in the future.
Dispute Resolution
These TOS and any dispute arising from or relating to these TOS or the provision of our Services shall be governed by the laws of the jurisdiction in which our company is registered, without giving effect to any conflict of laws principles.
Changes to These TOS
Dark Horse Virtue may revise these TOS from time to time, and the most current version will always be posted on our website. If a revision, in our sole discretion, is material, we will notify you via an email to the email associated with your account.
